Rishikul Yogshala — Public Service Agreement

1. Parties and Nature of the Agreement

This Public Service Agreement (“Agreement”) is concluded between Rishikul Yogshala (the “School”), registered and operating under the laws of the Republic of India, and any person (the “Student”) who submits an application and/or participates in any course, retreat, or program organized by the School.

This is a public offer: no individual paper contract is required. By accepting this Agreement (see Section 2), the Student enters into a legally binding arrangement with the School.

2. Acceptance of Terms

By (i) submitting the application form, and/or (ii) paying the deposit or any fee, the Student accepts this Agreement. No handwritten signature is required under Indian law for acceptance of online terms.

3. Services

The School provides yoga teacher training courses (200/300/500 hours), retreats and related educational, accommodation and ancillary services as described on the School’s official websites.

4. Student Code of Conduct (On-Campus Rules)

The School is dedicated to fostering a conscious and compassionate world and to creating a safe, sacred environment that promotes spirituality, ethical conduct, respect and trust.

  • Respect Indian tradition and School’s spiritual environment. The School is not a social club or resort.
  • Maintain a harassment-free atmosphere encouraging mutual respect, civility and friendly relations; all disagreements must be discussed openly and respectfully.
  • Use respectful language. Conflicts, negative gossip or rumor-spreading may lead to removal from the course.
  • Abstain on campus from tobacco, alcohol, recreational drugs, prohibited substances, non-prescribed medications, and from meat and fish during the stay.
  • Keep the room clean, including surfaces, dusting and sweeping.
  • Observe modesty and celibacy as encouraged by the School’s discipline; no public display of affection and no public nudity. Modest attire is required at all times.
  • Curfew: return by 9:45 PM; doors close at 10:00 PM.
  • No outside visitors without prior notice/approval.
  • No electronic devices (phones, etc.) in class or during meals. From 10:00 PM to 5:30 AM devices must be in airplane mode.
  • No food / hot drinks / coffee inside the yoga hall.
  • During class: no lying down, sleeping or loitering unless instructed by a teacher; no side-talking or disruption.
  • No photo/video/audio recording during classes without prior written permission of the Director.
  • Attendance is mandatory. Unexcused absences may result in denial of the certificate; an attendance letter may be issued instead.

5. Academic & Certification Requirements

The certificate (where applicable) is issued only if all of the following are met:

  • ≥ 90% attendance;
  • respectful and disciplined conduct;
  • successful completion of written and practical examinations.

If these are not met, only an attendance statement will be issued.

6. Study Materials & Intellectual Property

  • Students who leave early or change programs must return all training materials and manuals.
  • All training manuals remain the property of the School even while in the Student’s possession and may not be shared or distributed (digitally or physically) without written permission.

7. Health & Medical Responsibility

  • Students are responsible for their own medical care and must carry personal medications if needed. On-site medical support is limited to emergencies only.
  • The School is not responsible for accidents, illnesses, injuries or thefts occurring during the course, except in cases of gross negligence or willful misconduct (see Section 12).

8. Payments, Deadlines and Refunds

  • All fees, deposits, and refunds are governed by the Payment and Refund Policy published on the School’s website.
  • Deposits are non-refundable but may be transferred to another upcoming course, subject to availability and written approval from the School.
  • All fees are payable within 3 (three) days from the start of the course; otherwise registration may be cancelled and the deposit may be forfeited.
  • All payments are non-refundable. In exceptional cases (e.g., medical emergencies), the School may, at its discretion, process a partial refund after deducting fees for days attended.
  • If a course is postponed or cancelled due to unforeseen circumstances, the School’s liability is limited to a refund of amounts paid or an opportunity to transfer to another course (see also Section 9).

9. Transfer & Deferral Policy

If a Student withdraws for any reason, payments remain non-refundable. Before a course begins, the Student may request a one-time transfer to another course within two (2) years from the original start date. After this period, all payments lapse.

10. Media Release

The School may use group photographs taken during the course and events for record-keeping and promotional purposes. No individual close-ups will be used contrary to local laws or reasonable privacy expectations.

11. Classroom Discipline & Grounds for Removal

Breach of the Code of Conduct, academic dishonesty, distribution of School IP, harassment, violence, intoxication, or persistent disruption may result in disciplinary action, including expulsion without refund and denial of certification.

12. Assumption of Risk & Waiver of Liability

By participating, the Student voluntarily assumes all risks associated with yoga practice, travel, lodging and School activities and releases the School, its officers, teachers and staff from any and all claims for bodily injury, death, or property damage to the fullest extent permitted by law. Nothing in this Agreement excludes liability for gross negligence or willful misconduct.

13. Accuracy of Information & E-Signature

The Student certifies that all information provided in the application is true and complete. False, incomplete or misleading information is grounds for rejection, expulsion or revocation of a certificate.

By checking the acceptance box and typing the full name, the Student provides an electronic signature confirming:

  • acceptance of this Agreement, the refund policy, rules and liability waiver;
  • being 18+ and legally competent to enter into this Agreement;
  • being in appropriate mental and physical health to follow the course;
  • abstinence from alcohol and drugs during the course.

14. Language, Governing Law & Jurisdiction

This Agreement is drawn up in English. Translations may be provided for convenience only; in case of discrepancies, the English version prevails.

This Agreement is governed by the laws of India; courts of Uttarakhand, India have exclusive jurisdiction.

Кодекс поведения: уважать традиции; среда без домогательств; уважительная речь; запрет табака/алкоголя/наркотиков/лекарств без рецепта и мяса и рыбы; чистота комнаты; скромная одежда и поощряемый целибат; без публичного проявления привязанности/обнажения; комендантский час 21:45/двери 22:00; без посетителей без согласования; без гаджетов на занятиях и во время еды; с 22:00–5:30 режим «в самолёте»; без еды/горячих напитков в зале; на занятиях — без сна/разговоров; запись только с разрешения директора; посещение обязательно (иначе — справка о посещении).

5. Сертификация: ≥90% посещения, дисциплина, сдача письменного и практического экзаменов; иначе — справка о посещении.

6. Материалы и ИС: при уходе/смене программы вернуть материалы; пособия — собственность Школы; распространение без разрешения запрещено.

7. Медицина: ответственность Студента; помощь — только экстренная; Школа не отвечает за несчастные случаи/болезни/травмы/кражи, кроме грубой небрежности/умысла.

8. Платежи и возвраты: см. Политику оплат и возвратов на сайте; депозит невозвратный, можно перенести на ближайший курс при наличии мест и письменном одобрении; оплатить все сборы в течение 3 дней от начала, иначе регистрация может быть отменена и депозит аннулирован; платежи невозвратны, возможен частичный возврат при мед. форс-мажоре; при переносе/отмене курса — возврат уплаченного или перенос.

9. Перенос/отсрочка: однократный перенос до начала на любой последующий курс в течение 3 лет.

10. Фото/видео: возможна публикация групповых фотографий с учётом закона и приватности.

11. Дисциплина/отчисление: нарушения могут повлечь отчисление без возврата и отказ в сертификации.

12. Риски и отказ от ответственности: участие = принятие рисков и освобождение Школы в максимально допустимой законом степени; исключения — грубая небрежность/умысел.

13. Достоверность и e-подпись: подтверждаю достоверность данных; ложные сведения — основание для отказа/отчисления/отзыва сертификата; флажок и ввод ФИО = электронная подпись (согласие с правилами, возраст 18+, здоровье, воздержание от алкоголя и наркотиков).

14. Язык/право/суды: приоритет — английский текст; применимо право Индии; юрисдикция — суды Уттаракханда.
